The short version (in plain English)

1. Welcome — and what you're agreeing to

By creating an account or using brb. (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use brb. — but we hope you'll stick around because we built this thing for teachers like you.

brb. is operated by Big Brain Labs LLC, a company owned and run by a teacher. You can reach us anytime at support@bigbrainlabs.org.

2. What brb. does

brb. is a touchless sign-out kiosk for K-12 classrooms. It runs in any modern web browser on an iPad, Chromebook, laptop, or desktop. Students sign in and out of the room using touch, mouse, or hand gestures detected by the device's camera. Photos and roster information stay on the teacher's device — they never get uploaded to our servers.

3. Who can use brb.

You need to be at least 18 years old and a teacher, school administrator, or other adult education professional. By signing up, you're confirming that's you.

4. Your account

Signing up

You create your brb. account through Google or email via our authentication provider Clerk. Keep your sign-in credentials safe — you're responsible for what happens on your account.

One account per teacher

A brb. purchase covers one teacher across their classroom devices. Schools or districts wanting to outfit multiple teachers should email support@bigbrainlabs.org for institutional pricing — we're happy to work something out.

You're responsible for activity on your account

That includes how students interact with the kiosk on devices you've set up. If something looks fishy or your account gets compromised, let us know right away.

5. Free trial, purchase, and billing

The 14-day free trial

New accounts get 14 days of full access — no credit card required to start. After the trial, make a one-time purchase to keep using brb.

Pricing

brb. is a one-time purchase of $29.99 per teacher — you buy it once and own the version you bought. There is no subscription and no recurring charges.

We may change the price in the future, but a change never affects a purchase you've already made — what you bought stays yours.

No auto-renewal

Because brb. is a one-time purchase, there is nothing to renew and your card is never charged again after the initial purchase. Our payment processor Lemon Squeezy emails you a receipt.

Payment processing

All payments go through Lemon Squeezy, who acts as the Merchant of Record. They handle the actual payment, taxes (including VAT/GST if applicable), and receipts. We don't see or store your full payment card details.

Discount codes

From time to time we issue discount codes (launch promos, press comps, etc.). Each code has its own conditions — eligibility, expiry date, maximum uses — set when we create it. We may invalidate codes that get distributed against the spirit of how they were issued.

6. Refunds and account deletion

No subscription to cancel

brb. is a one-time purchase, so there's no subscription to cancel and no recurring charge to stop. You keep the version you bought.

Refunds

If brb. isn't a fit, request a full refund within 14 days of your purchase by emailing support@bigbrainlabs.org. After 14 days the purchase is final.

Account deletion

You can request deletion of your account anytime by emailing us. We'll delete your data within 30 days.

7. Acceptable use

The honest version: don't be a jerk, don't break things on purpose, and don't try to scam the system. Specifically, you agree NOT to:

8. Student privacy and your responsibilities

brb. is designed so that all student data — names, photos, pass records — stays on your device and never reaches our servers. That part is on us, and it's a core promise we don't break.

That said, you're still the one in the classroom, so you're responsible for:

brb. provides the tools — you're the educator who knows your district's policies. We can't enforce those for you, but we make it as easy as possible to comply.

If your district has a vendor review process, formal Data Processing Agreement, or specific compliance requirements (FERPA, COPPA, NY Education Law 2-d, SDPC, state-specific laws), we're happy to work with your privacy office. Email support@bigbrainlabs.org with what you need.

Because brb. doesn't transmit student data to our servers, vendor approval tends to be much faster and simpler than typical edtech. See our Privacy Policy for the full district readiness section.

Multi-teacher pricing for schools and districts is available. Email us for a quote — we won't make it complicated.

9. Service availability

We work hard to keep brb. running smoothly, but we don't guarantee 100% uptime. brb. might be temporarily unavailable for maintenance, updates, or because of stuff outside our control (network issues, third-party provider outages). Good news: brb. caches your roster and pass data locally, so it can usually keep working even if our backend is briefly down.

We may modify, suspend, or discontinue brb. with reasonable notice. If we ever fully shut down brb., we'll offer a fair refund of recent purchases.

10. Intellectual property

brb. — including its design, code, name, and content — belongs to us. We're giving you a limited, non-exclusive license to use it for your classroom under these Terms. Don't copy it, modify it, or make derivative works.

If you submit feedback or bug reports, we may use that feedback to improve brb. without restriction. By sending feedback, you grant us a perpetual, royalty-free license to use it.

11. The standard "as is" disclaimer

brb. is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We don't promise brb. will be error-free, never go down, or fix every defect.

brb. is a tool to help you manage your classroom — it's not a replacement for your professional judgment about student safety, attendance, or supervision. Use it as one of many things in your toolkit.

12. Limitation of liability

To the fullest extent the law allows, our total liability to you for any claim related to brb. is capped at the amount you paid us in the 12 months before the claim.

We're not liable for indirect, incidental, special, consequential, or punitive damages — things like loss of data, lost profits, or business opportunities — even if we'd been warned that could happen. This applies regardless of the legal theory (contract, tort, statute, etc.). Some places don't allow this kind of limitation, so it might not fully apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your use of brb., (b) violations of these Terms, (c) violations of third-party rights (including students or their parents), or (d) data you submit through brb.

14. Termination

We may suspend or terminate your account if you break these Terms. We'll give reasonable notice unless the violation is serious enough that notice isn't practical.

You can terminate anytime by emailing us. When your account ends, your access ends immediately and we delete your account data within 30 days.

15. Changes to these terms

We may update these Terms occasionally. If we make material changes, we'll email you at least 30 days before they take effect. Continuing to use brb. after that means you're cool with the updates. If you're not, cancel before the change date.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes get resolved in state or federal courts in Nassau County, New York, and you consent to personal jurisdiction there.
